Terms of Use

1. Definitions

In these Terms of Use, the following terms have the meaning set out below:

  • Hjelte Racing — the operator of the Portal, contactable at hjelte@hjelteracing.com.
  • Portal — the website at ambassadors.hjelteracing.com and all associated digital services.
  • Ambassador — an invited member of the HRC Ambassadors Club whose email address has been added to the allowlist by Hjelte Racing.
  • User — any natural person who accesses or uses the Portal.
  • Content — all materials made available via the Portal, including race news, videos, photos, predictions, comments, cheers, leaderboards, badges and embedded third-party media.
  • Magic Link — the single-use, time-limited login link sent to an Ambassador’s email address by which authentication takes place.

2. Applicability and acceptance

These Terms of Use apply to every use of the Portal. By requesting a Magic Link, logging in, or otherwise using the Portal, the User confirms that they have read, understood, and agreed to these Terms, the Privacy Policy and the Disclaimer.

If the User does not agree, they must not use the Portal.

3. Access to the Portal

The Portal is a private, invite-only platform for the founding members and subsequent invited members of the HRC Ambassadors Club. Access is granted exclusively at the discretion of Hjelte Racing.

Access requires:

  • An email address that has been added to the Portal’s allowlist by Hjelte Racing.
  • Verification of that email address by clicking the Magic Link, which is valid for a limited period.
  • A device with a modern web browser supporting HTTPS, JavaScript and cookies.

Access is strictly personal. Magic Links, active sessions, and account credentials may not be shared with, transferred to, or used by any third party. If Hjelte Racing has reasonable grounds to suspect unauthorised sharing, it may suspend or revoke access without notice.

Hjelte Racing may at any time add, remove or change Ambassadors on the allowlist, including ending an Ambassador’s access if their relationship with the club concludes.

4. Permitted use

The Ambassador may use the Portal and the Content for the following purposes:

  • Personally viewing the Content made available to them through the Portal.
  • Participating in the community features — posting comments, giving cheers, submitting race predictions, completing onboarding, and customising their profile.
  • Sharing race-related Content (such as race results or club news) with friends and family in a private, non-commercial context, where Hjelte Racing has clearly indicated this is permitted.

5. Prohibited use

The User is expressly not permitted to:

  • Share Magic Links, login sessions, or any other access credentials with third parties.
  • Attempt to access the account, profile or data of any other Ambassador without authorisation.
  • Use the Portal for any commercial purpose without Hjelte Racing’s prior written consent.
  • Sell, license, rent, redistribute, or otherwise commercially exploit any Content from the Portal.
  • Use automated means (bots, scrapers, crawlers) to extract Content or metadata.
  • Reverse engineer, decompile, or disassemble any part of the Portal.
  • Remove watermarks, logos, copyright notices or other identifying marks from Content.
  • Post comments, cheers or any other user-generated content that is unlawful, harassing, defamatory, discriminatory, threatening, sexually explicit, or otherwise harmful to other Ambassadors or third parties.
  • Impersonate another person, misrepresent affiliation, or submit false race predictions on behalf of another User.
  • Use the Portal in any manner that disrupts its operation, undermines its security, or violates applicable law.

6. User-generated content

Comments, cheers, predictions and any other content submitted by an Ambassador (“User Content”) remain the responsibility of the Ambassador who submitted them. By submitting User Content, the Ambassador represents that they have the right to do so and grants Hjelte Racing a non-exclusive, royalty-free, worldwide licence to display, store, and moderate that User Content within the Portal for the purpose of operating the community.

Hjelte Racing may at its sole discretion edit, hide, or remove User Content that breaches these Terms or that it considers inappropriate, without prior notice and without obligation to justify the action. Hjelte Racing does not actively monitor every contribution and is not responsible for User Content posted by other Ambassadors.

7. Intellectual property

All intellectual property rights in the Portal, its design, branding, source code and editorial Content (including race news, badges, points logic and curated media) are owned by Hjelte Racing or its licensors. Nothing in these Terms transfers any of those rights to the User.

The Ambassador receives a personal, non-transferable, non-exclusive, royalty-free licence to access and view the Content via the Portal for the duration of their membership and solely for the purposes set out in section 4.

Where the Portal embeds content from third-party platforms such as YouTube or Instagram, that content remains the property of its respective rights holders and is governed by their terms.

8. No account system

The Portal uses Magic Link authentication and does not rely on permanent password-based accounts. This means:

  • The User does not create an account with a password.
  • Access is granted by verifying the User’s allowlisted email address through a single-use Magic Link.
  • Active sessions remain valid for a limited period, after which a new Magic Link is required.

For the deletion of personal data, please refer to the Privacy Policy.

9. Termination of access

Hjelte Racing may suspend or terminate a User’s access to the Portal with immediate effect and without prior notice in any of the following cases:

  • The User has breached these Terms.
  • There are reasonable grounds to suspect fraud, misuse, or improper use of the Portal.
  • The Ambassador’s relationship with the HRC Ambassadors Club has ended.
  • Hjelte Racing chooses to discontinue, fundamentally alter, or rebrand the Portal.

Termination of access does not entitle the User to any compensation.

10. Liability

Hjelte Racing’s liability in connection with the Portal is governed by the Disclaimer. The limitations of liability set out there apply in full to these Terms.

11. Privacy

The processing of personal data is governed by the Privacy Policy. By using the Portal the User confirms they have read it.

12. Complaints and disputes

Complaints about the Portal or about Hjelte Racing’s services may be submitted in writing to hjelte@hjelteracing.com. Hjelte Racing will aim to respond within fourteen working days and will seek to resolve complaints in good faith.

Any dispute arising out of or in connection with these Terms or the use of the Portal that cannot be resolved amicably will be submitted exclusively to the competent court in the district where Hjelte Racing has its registered office, unless mandatory law designates a different competent court.

13. Governing law

These Terms, the use of the Portal, and all rights and obligations arising from them are governed exclusively by the laws of the Netherlands.

14. Changes

Hjelte Racing may update these Terms from time to time. The most recent version is always available at /legal/terms. For material changes, Hjelte Racing will notify Ambassadors by email at the address used for Portal access. The revised Terms take effect thirty days after the announcement, unless mandatory law requires a different period.

If the User does not agree to the revised Terms, they must stop using the Portal. Continued use after the effective date constitutes acceptance of the revised Terms.

15. Final provisions

Entire agreement. These Terms, together with the Privacy Policy and the Disclaimer, constitute the entire agreement between the User and Hjelte Racing regarding the use of the Portal and supersede any prior arrangements.

Severability. If any provision of these Terms is held invalid or unenforceable by a competent court, the remaining provisions remain in full force and effect.

No waiver. A failure by Hjelte Racing to enforce any provision at any time is not a waiver of its right to enforce that provision later.

Assignment. Hjelte Racing may assign its rights and obligations under these Terms to a third party, for example in the context of a merger, acquisition or sale of business. The User may not assign their rights or obligations to any third party without Hjelte Racing’s prior written consent.
